The #HuggiesBabyButts Bop Sweepstakes (the “Sweepstakes”) starts on May 16, 2023 at 12:00 a.m. Eastern Time (“ET”) and ends on June 16, 2023 at 11:59 p.m. ET (the “Sweepstakes Period”). This Sweepstakes is in no way sponsored, endorsed, or administered by TikTok.
ELIGIBILITY: Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older and features a child 3 years of age or under in their content with them. Employees, officers, directors and representatives of Kimberly-Clark Corporation (“Sponsor”), Weber Shandwick (“Administrator”), and their respective parents, subsidiaries, affiliates and their promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. Sweepstakes is void outside of the United States and where prohibited and is subject to all applicable federal, state and local laws.
HOW TO ENTER: To enter the Sweepstakes, you'll first need to become a registered user of TikTok (“TikTok”) by signing-up for a free account at tiktok.com, or log-in to your TikTok account. If you do not agree to TikTok’s requirements and restrictions or these Official Rules, do not participate in the Sweepstakes. Data charges may apply if you are accessing TikTok from your mobile device to participate in this Sweepstakes. Check your wireless carrier for mobile phone capabilities and pricing plan details.
During the Sweepstakes Period, log-in to your TikTok account and post a video of yourself and a child 3 years of age or younger dancing to the “Huggies Baby Butts Bop” song on the TikTok platform, tag @huggies, and include the hashtags #HuggiesBabyButts and #sweepstakes in the caption of your post to receive one (1) entry into the Sweepstakes (collectively, a “Submission”). You can access the “Huggies Baby Butts Bop” song by searching for song title in the “sounds” toggle when a user creates content. Submissions must be received by June 16, 2023 at 11:59 p.m. ET in order to be eligible. Please Note: The content of your Submissions will not be judged, and therefore will not increase or decrease your chances of winning a prize.
The entrant will be, and any prize won will be awarded to, the authorized account holder of the TikTok account associated with the Submission. You, as the entrant, must be depicted in the video. You do not need to be the parent or legal guardian of the child depicted in the video, but you need to have permission from the child’s parent or legal guardian for the Submission. If you do not take the video, you also need permission from the person taking the video for the Submission. Submission should not include any persons other than yourself and the authorized child, unless you have express permission from such person for the Submission.
Your Submission must adhere to TikTok’s requirements and restrictions and these Official Rules. Submissions must be publicly posted. Sponsor and Administrator will not receive Submissions from users with “protected” or “private” accounts or posts. Private or protected posts not received by Sponsor or Administrator will be invalid. Note: If you have your TikTok account set to private, or deactivate your TikTok account at any time prior to the end of the Sweepstakes Period, your Submission will not be considered.
Content Restrictions: Your Submission may not contain any content that the Sponsor or Administrator, in its sole discretion, determines to:
- be vulgar, offensive, sexually explicit, profane or pornographic;
- be derogatory of any race, ancestry, place of origin, color, ethnic origin, citizenship, religion, sex, sexual orientation, age, marital status, family status or disability; endorses any form of hate or hate group; defames, misrepresents or contains disparaging remarks about other people, products or companies;
- be violent or promotes the use of alcohol, illegal drugs, tobacco, or weapons; promotes unsafe activities;
- promotes any religious or political agenda or message;
- contain copyrighted materials owned by others (including music, lyrics, or images published on or in websites, television, movies or other media) without permission;
- contain third-party trademarks, logos, trade dress or insignia (such as distinctive packaging or building exteriors/interiors), including brand names of products (other than products of Sponsor) owned by others without permission, to the extent permission is necessary;
- contain any personal identification, such as persons’ names, e-mail addresses, street addresses or license plate numbers;
- communicate messages inconsistent with the positive image of the Sponsor’s name and/or any of its brands;
- contain any material that violates or infringes another's rights, including but not limited to material that violates privacy, publicity, or intellectual property rights, or that constitutes copyright infringement;
- include or refer to any third parties, including but not limited to minors, celebrities and friends or family members who have not authorized such inclusion or reference; or
- violate any law.
By participation – each entrant covenants, warrants and represents that such entrant’s Submission is the original work of the entrant, has not been previously published, has not won previous awards, and does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. By posting a Submission, entrant covenants, warrants and represents that entrant and any persons identifiable in the entry (including but not limited to the parents or legal guardians of the child depicted in the Submission) consent to the Submission and use of the Submission in the Sweepstakes and to its use, exploitation and exhibition and any other action of Sponsor with respect to the Submission as set forth herein.
Limit one (1) Submission per person and per TikTok account for the duration of the Sweepstakes Period. Multiple participants are not permitted to share the same TikTok account or submit a previously submitted video via a different TikTok account. Submissions received from any person in excess of the stated limitation will not be considered. Should multiple users of the same TikTok account participate in the Sweepstakes and a dispute thereafter arises regarding the identity of the participant, the authorized account holder of said TikTok account at the time of submission will be considered the participant and required to comply with these Official Rules. The "authorized account holder" is the natural person assigned an account by TikTok. Use of any automated system and use of any other devices to subvert the submission process to participate is prohibited and will result in disqualification (and all associated Submissions will not be considered). The potential award recipients may be required to show proof of being the authorized account holder of a TikTok account and permission from all persons depicted in the video and the person taking the video. Submissions received from any person or TikTok account in excess of the stated limitation will be void. Entries generated by script, macro, or other automated means and Submissions made by any means or practices which subvert the Submission process are void.
RANDOM DRAWING/ODDS: On or about June 18, 2023, Administrator will select twenty (20) potential winners in a random drawing from among all eligible Submissions received. Odds of winning a prize depend on the number of eligible Submissions received throughout the Sweepstakes Period.
WINNER NOTIFICATION: Potential winners will be notified by Administrator by TikTok direct message or comment and must respond within twenty-four (24) hours. Potential winners may be required to sign an affidavit of eligibility and liability/publicity release within five (5) days of notification. If any prize or prize notification is returned as undeliverable, Sponsor or Administrator is unable to contact a potential winner or a potential winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor’s or Administrator’s discretion, an alternate winner may be selected. Sponsor or Administrator, in its sole discretion, will attempt to contact up to two (2) potential winners of a prize in accordance with the above procedure, after which the prize in question may go unawarded if it remains unclaimed.
PRIZES (20): Each prize (“Prize”) consists of one (1) copy of The AlphaButt Book and one (1) Huggies diaper product of Sponsor’s choosing. Approximate Retail Value (“ARV”) of each Prize: $30.00.
PRIZE CONDITIONS: All federal, state and local taxes and all other costs associated with Prize acceptance are the sole responsibility of the winners. Winners may not substitute, assign or transfer Prize or redeem Prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute Prize (or portion thereof) with one of comparable or greater value. All Prize details are at Sponsor’s sole discretion. Total ARV of all prizes: $600.00.
GENERAL CONDITIONS: By participating, you agree: (a) to abide by these Official Rules and decisions of Sponsor, which shall be final and binding in all respects relating to this Sweepstakes; (b) to release, discharge and hold harmless Sponsor, Administrator, TikTok, and their respective affiliates and their franchisees, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the foregoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from your participation and the participation of anyone associated with your Submission in the Sweepstakes or any Sweepstakes-related activity or the acceptance, possession, use or misuse of a Prize (or any portion thereof); and (c) to the use of your name, photograph, Submission, and/or likeness (of yourself and all persons depicted in your Submission) for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from you or any third party and without prior notice, approval or inspection, and to execute specific consent to such use. By participating, you also agree not to release any publicity or other materials on your own or through someone else regarding your participation in the Sweepstakes without the prior consent of the Sponsor, which may be withheld in its sole discretion. All causes of action arising out of or connected with this Sweepstakes, or any Prize awarded, shall be resolved individually, without resort to any form of class action.
LICENSE/USE OF SUBMISSIONS: By posting a Submission on TikTok, and to the extent allowed by law, you (on behalf of yourself and anyone depicted in the Submission) grant the Released Parties a perpetual, worldwide, royalty-free, non-exclusive, sub-licensable, unconditional and transferable license to edit, modify, cut, rearrange, add to, delete from, reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, adapt, exhibit and/or otherwise use or reuse your Submission, name, TikTok post, and biographical material including, but not limited to, all materials submitted in connection with the Sweepstakes in any and all media, throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation to entrant or any third party.
MISCELLANEOUS: Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled Submissions, or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of Submissions, the announcement of the Prizes, or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to any person's computer, phone, tablet or other device related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Sweepstakes or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor or Administrator, will be disqualified and all associated Submissions will be void. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised for any reason, including virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or posting of Submissions, Sponsor or Administrator reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes (or portion thereof) and, if terminated, at its discretion, select the potential winners from among all non-suspect, eligible Submissions received prior to action taken. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Wisconsin, without giving effect to any choice of law or conflict of law provisions.
